GENERAL TERMS AND CONDITIONS

These terms govern your use of, and purchases from, the domains www.pebbles.me and their sub domains (henceforth: the site) and will be valid for all your future transactions with The Contrology Collection Sweden AB and Pebbles (henceforth: Pebbles; may be referred to as ‘us’) and visits to the site. By making a purchase from, or using, the site you have agreed to these Terms and Conditions and entered into a binding agreement with Pebbles. Please make sure that you have read and understood these terms when using our site. Pebbles reserves the right to revise these Terms and Conditions and users are responsible for keeping themselves updated with such changes.

ORDERING

All orders submitted by you are subject to acceptance by us. We may choose not to accept your order and reserve the right not to deliver for any reason without any liability to you. Examples of when we may not accept your order include, but are not limited to, incorrect stock level shown on site at the time of receiving the order or if we are unable to authorize your payment.

Once we have received your order you will receive an automatic e-mail confirming your order. Please note that the confirmation e-mail is only an acknowledgment that we have received your order and not an acceptance of your order. Once the order has been processed you will receive a shipping confirmation e-mail. Pebbles does not guarantee that all items included on the site are in stock at the time of your order. In the event that an item is unavailable you will be contacted shortly by phone or e-mail. Pebbles cannot guarantee that the content on the page is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date and Pebbles may at any time amend the content of the site. Pebbles holds the right to change prices, correct incorrect prices on all orders as well as final sales and will give you the option of placing a new order with the correct price or canceling your order.

We reserve the right to limit the quantities of Pebbles products that we supply, and/or to refuse any order that is unusual or placed in bad faith. In addition, we reserve the right to refuse any order from a client with whom there is a dispute concerning the payment of a previous order. All attempts at fraud will be reported to the police and Pebbles reserves the right to cancel the purchase if any suspicion is raised.

RESALE POLICY

You may purchase products on the site for personal use only and not for resale. By placing an order on the site you certify that you are purchasing the product for your own personal use and not for resale and that you accept our Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.

PRODUCT

Pebbles has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible but we reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the products. We cannot guarantee that colors on the website will be true to life. This depends partly on color settings of your computer and monitor.

PRICES

The prices on the site are in SEK in Sweden and EUR. For customers visiting the site from countries with other local currencies than the ones offered, an estimated conversion to the local currency based on the current exchange rate may be displayed. Unless your local currency is supported, you will be billed in EUR and the final price charged to your account or credit card will be calculated in accordance with the applicable exchange rate on the day your bank or credit card company processes the transaction and according to their rates. Pebbles has no control over these rates and do not take responsibility for any potential exchange rate differences or exchange fees levied by your bank.

Prices do not include delivery charges. All prices shown on the site include VAT. Please note that in some countries outside of EU and outside the US additional duties may be payable to your local authorities on receipt of your delivery. You will be responsible for payment of any such import duties and taxes. Pebbles has no control over these charges and cannot predict their amount. For further information we suggest you contact your local customs office before placing your order.

Pebbles may vary the prices of Products listed on the site at any time and without any notice but such changes will not apply to Products in respect of which you have been sent a Dispatch Confirmation. If you have been charged the wrong amount in the web shop Pebbles will give you the option to place a new order with the correct price or cancelling your order. Pebbles however reserves the right to cancel your order prior to dispatch should we find that the price is incorrect. In such case we will notify you by e-mail. We are under no obligation to provide goods to you at an incorrect lower price, even once we have sent a Dispatch Confirmation to you, if the pricing error is obvious and unmistakeable and could have been recognized by you as an error.

PROMOTIONS

The promotion codes are limited to one time per customer and cannot be combined with other offers, if not otherwise explicitly stated. Promotion codes and offers are only valid within the explicitly set time or as far as we have stock and not applicable to previously placed orders.

PAYMENT

We offer payment methods with PayPal, credit and debit card. When paying by card you will be asked for the card number, the name of the cardholder, its period of validity and the CVC code. Other payment methods may require birth date, personal ID numbers or bank account number. We do not store any credit card information or such sensitive information solely necessary for payment and all information is encrypted using SSL encryption, which prevents unauthorized access to card details. Extra charges from PayPal depending on payment method may apply but will be clearly stated in checkout. Charges by PayPal for late payments may apply. In the event no payment has been received after submitting your order Pebbles may automatically cancel your order. You confirm that the credit/debit card, bank information or other personal information that is being used is yours or that you have been specifically authorized by the owner of such credit/debit card, bank or personal information.

DELIVERY

Pebbles ships worldwide. All orders are shipped from our warehouse in Stockholm and delivered by UPS or PostNord. We require a physical street address and signature upon delivery. We are unable to deliver to post office boxes. If UPS are unable to deliver, you will be notified by letter, sms or e-mail and you can either schedule another delivery attempt or have the package delivered to a UPS Service Point where you can pick it up at your convenience within 10 days. Please note that UPS’s services and processes differs among countries and cities. Pebbles cannot be held responsible for changes to UPS terms of service, therefore please refer to ups.com for current information for your specific location.

When your order leaves our warehouse you will receive a tracking number via e-mail which you can use to track your order. At any time, you can check the status of your package using the link in the shipping notification. Unclaimed packages will be returned to us. For all unclaimed packages you will be debited all fees in connection with the return delivery.

Pebbles insures each purchase during time in transit until it is delivered to you. Orders outside Sweden require a signature upon delivery, at which point responsibility for the shipment passes to you. If you have specified a recipient other than yourself for delivery purposes, you also accept that signature by the third party is sufficient proof of delivery and fulfillment by Pebbles. We are unable to deliver to post office boxes.

Goods will be dispatched on regular working days, Monday to Friday. We aim to dispatch all orders within 24 hours. Delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorization, stock availability, customs clearance processes, faulty delivery information or any other unforeseen activities. Please note that the following delivery charges do not include import costs (such as taxes or import duties) that may be due when packages reach the country of destination.

We occasionally offer free deliveries on all orders, which will be clearly stated on our website. Please note that campaign for free deliveries will be activated on your order in the checkout.

RETURNS AND EXCHANGES

Pebbles has a 30 days return period. Any returns must be shipped/postmarked within 30 days of reception. Pebbles shall as soon as possible, if under the jurisdiction of our return policy, refund you what you have paid for the returned item, or exchange the item. Upon reception of the returned item, we control the goods prior to processing the refund or exchange. Refunds are authorized by Pebbles and may be processed by PayPal or Pebbles. Refunds are made either to the original purchaser’s credit card or bank account and take 2-5 business days to show up on your account, from the time they have been authorized by Pebbles.

When returning a product you are obliged to keep the product in the same condition as when delivered. You must not have used the product/service, however you have the right to investigate the condition the product was in when delivered. All original packaging, price labels etc shall be returned with the product without having been tampered with.If damage or harm is caused to a product while investigated the product does not qualify for the return policy.

EXCHANGES

Purchased items are exchangeable into a different size and color. All exchanges are based on stock availability and are shipped to you free of charge. Should you be interested in an alternative style, please return your item/s to us and simply purchase the new piece separately at pebbles.me. Sale items are non-exchangeable but can be returned for a full refund. For countries outside of EU and outside the United States taxes and duties may apply which will not be covered by Pebbles. Since tax and import duties vary from country to country, we cannot provide an exhaustive list of applicable rules. Instead, we ask you to turn to your local customs authorities for more information.

DEFECTIVE PRODUCTS

If the product is damaged or does not correspond with how the product was presented on the site you have the right to enter a claim. Please contact hello@pebbles.me as soon as you discover the fault. We will first try to see if it is possible to repair or remedy the fault. If this is not possible then we will replace the product. If we are unable to replace the product or remedy the fault then we will refund the money. If you can send a photograph of the damage/error this will speed up the process. When we have received the product and approved the claim you will be informed and a new product along with compensation return-shipping costs will be sent to you, or we will refund you for the product and the return-shipping costs.

EXCHANGE AND REFUND CHARGES

All orders are fully refunded, including full item value and any shipping fees paid.

Within the EU and US, return shipping and shipping of any replacement item(s) is free of charge and provided by Pebbles through UPS.

Outside of EU and US, the customer is obliged to pay for and arrange the return shipping of the item(s). Please note that any potential customs duties and sales taxes are non-refundable through Pebbles. In case of exchange, shipping of any replacement item(s) is free of charge and provided by Pebbles through UPS.

For any shipping country, pre-paid return slips are only valid when returning from the same country the order was originally shipped to. Should you return your order from another country than the one it was shipped to, please contact our customer care.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, such as trademarks and copyright, on the site and in the material published on it are owned by or licensed to Pebbles and it’s affiliates. You are authorized to use this material only for personal, non-commercial purposes. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Pebbles. You may not modify the material in anyway, without the prior written permission of the copyright owner. For press inquiries, please visit our press page.

USER CONTENT

The Pebbles website may include user generated content, e.g. from social media applications. Pebbles does not claim any ownership in rights in such content (images, photos, videos, etc.) and take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise are offended by such content, please contact our customer service.

PRIVACY POLICY

When ordering a product on the site you will be asked to fill in your personal information. Upon purchase you agree to this information being stored in accordance to Pebbles’ privacy policy in order to fulfill our agreement to you as a customer. All personal information saved at the site will be handled with the utmost care. Pebbles treats all personal information confidential and it will not be sold or used for any other purposes than to process and fulfill your order and ensure the best service possible. Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. You have the right to request access to your data and if there is anything wrong you may have it changed or removed. If this is the case, send us an e-mail clearly stating your name, e-mail address and a short description of the matter.

When completing an order you have the option not to receive any promotional information or newsletters from Pebbles. If you no longer wish to receive information that is not necessary to fullfil your order, please unsubscribe directly in the e-mails by clicking the “Unsubscribe” button in the footer of the mailing in question or contact us by e-mail at hello@pebbles.me.

For security reasons, we do not store any payment information in our database.

COOKIES

Yes. Cookies are used in the site, in order to improve your experience of the site. As you navigate our site, your preferences are remembered through the temporary use of “session” cookies. Cookies enable our systems to gather information about your browser as well as monitor the navigational patterns you take while browsing the site. Site users have the option to accept or disable cookies through their browsers, as well as being notified when a cookie is to be activated. This enables you to reject usage of this cookie or erase the cookie at the end of your visit. If you choose to disable your cookies or erase cookies, your user experience may be limited.

TERMINATION

Pebbles reserves the right to terminate your account and/or use of the site at its sole discretion. For example if Pebbles suspects that you have in any way breached the Terms and Conditions. Such termination can be made without prior notice.

LIABILITY

Pebbles responsibility for errors in connection to delivery is limited to existing conditions of sale. Pebbles bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.

Part of the services mediated through the site are maintained by outside organizations. Where Pebbles acts as an agent for such services, we cannot be held responsible for any errors resulting from their activities. Pebbles cannot be held responsible for any damage caused from using, or not being able to use, the site. Pebbles cannot guarantee a problem-free, uninterrupted, and secure access to the site. The site may contain links to other website beyond our reach. We cannot be held liable for content or privacy policies of such sites.

FORCE MAJEURE

We have the right to assert force majeure in the event of war, warlike event, civil war, revolution, government sanction, strike, lockout, blockade, natural disaster or the like. This means that the agreement will not need to be fulfilled in part or in full. Should this, contrary to expectation, occur, we would attempt to notify you. Under such circumstances, Pebbles will attempt to resolve all issues in a timely manner.

GOVERNING LAW

These Terms and Conditions are compiled in accordance with Swedish law. To the extent permitted by law, Swedish courts will have exclusive jurisdiction over any dispute under this agreement. The laws of your country may differ from Sweden and there may be additional legal requirements to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our site.
